REPORT OF THE CAMPUS & COMMUNITY AFFAIRS COMMITTEE (CCAC)

FOR APPROVAL

1. Statement of Principles for Trademark Licensing and the Code of Conduct for Trademark Licensees doing Business with The University of Western Ontario

Recommended: That the Board of Governors approve the following:

a. The Statement of Principles for Trademark Licensing (Appendix IV, Annex 1A)

b. The Code of Conduct for Trademark Licensees Doing Business with The University of Western Ontario Book Store (Appendix IV , Annex 1B);

and

The amendment to Section 5.00 of Policy 1.17 (Licensed Commercial Use of University Name and Trademarks) as follows, to link that policy to the Code of Conduct for Trademark Licensees Doing Business with The University of Western Ontario Book Store :

5.00 Applications for the commercial use of the University's name and derivative names, insignia, logos or other graphic marks shall be made in the first instance to the Licensing Coordinator*. Such applications must include the information required by the "Code of Conduct for Trademark Licensees".

• The Director of the UWO Book Store is the Licensing Coordinator.

Background:

The attached (Annexes 1A and 1B) are based closely upon the policies and procedures adopted by both the University of California system (all campuses) and more recently by the University of Toronto. It is proposed that what the University of California and the University of Toronto call a "policy", be called a "Statement of Principles for Trademark Licensing" to avoid confusion with Western's "Policies and Procedures" on Licensed Commercial Use of University Name and Trademarks (Policy 1.17, attached as Annex 2).

Other distinctions of the proposed Statement of Principles and Code of Conduct from those of the University of California and University of Toronto are:

• The Board of Governors, rather than the President, shall establish a code of conduct and shall designate the appropriate university office to ... etc. This language is in Paragraph VI in the Statement of Principles and is consistent with Western's Policy 1.17.
• Paragraphs VII and IX of the Statement of Principles make reference to the "Licensing Coordinator" (who is the Director of the University Book Store)
• In Paragraph V of the Code of Conduct for Trademark Licensees, there is reference to "renewal" (rather than "annual renewal" as used in the California and Toronto codes). It is planned that licenses will be granted for three-year periods.

The University of Toronto has granted permission to Western to use their document. Permission has been requested from the University of California.
